Withdrawal Policy for Consumers

This Withdrawal Policy applies exclusively to consumers within the meaning of section 13 of the German Civil Code (Bürgerliches Gesetzbuch – BGB). Entrepreneurs and business customers within the meaning of section 14 BGB do not have a statutory consumer right of withdrawal.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date on which the contract is concluded.

of your decision to withdraw from this contract by means of a clear statement, for example a letter sent by post or an email.

You may use the model withdrawal form provided below, but use of the model withdrawal form is not mandatory.

When you use this online function, we will immediately provide you, on a durable medium such as by email, with a confirmation of receipt containing information about the content of your withdrawal declaration and the date and time at which it was received.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal or submit it through the electronic withdrawal function before the withdrawal period has expired.

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days from the date on which we receive your communication concerning your withdrawal from this contract.

We will make the reimbursement using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

Where the payment amount has only been authorised and has not yet been finally captured, prokodo will cancel or release the payment authorisation, provided that this is still technically possible.

Depending on your payment service provider or card-issuing bank, additional processing time may be required before the release of the authorised amount is visible in your account or on your credit card.

The Website Potential Analysis is created individually for the website specified by you. The analysis begins immediately after successful completion of the Stripe Checkout and confirmation of the payment authorisation.

For an order placed by a consumer, prokodo will begin the analysis before expiry of the fourteen-day withdrawal period only where you have previously expressly requested and agreed that prokodo begin performing the service before expiry of the withdrawal period.

For consumer orders, the following separate, non-preselected declaration is obtained during checkout:

I expressly request and agree that prokodo begin the website analysis immediately after successful payment authorisation and therefore before expiry of the withdrawal period. I am aware that my right of withdrawal expires once prokodo has fully performed the contract. The service is fully performed once a contractually compliant deliverable report has been created, personal report access has been set up and the report link has been sent to the email address I provided.

The submission of this declaration, including the text version used and the date and time of the declaration, is recorded.

Your right of withdrawal expires before the end of the fourteen-day withdrawal period upon full performance of the contractually owed service where, before performance begins, you have:

1. expressly requested and agreed that prokodo begin the website analysis before expiry of the withdrawal period; and
2. confirmed that you are aware that you will lose your right of withdrawal once prokodo has fully performed the contract.

The service is fully performed once:

1. a contractually compliant deliverable report has been created in final form in accordance with the agreed product scope;
2. personal access to that report has been set up; and
3. the personal report link has been sent to the email address provided by you when placing the order.

A report may also be contractually compliant and deliverable where individual pages, content, measurements or areas of analysis could not be analysed, or could not be analysed completely, due to the technical characteristics or accessibility of the specified website. The relevant consideration is whether the report as a whole contains the essential results and recommended actions of the purchased product scope in a usable form.

Once the service has been fully performed and valid consent to early performance has been provided, withdrawal is no longer possible.

Where we receive your withdrawal declaration before the service has been fully performed, the analysis will be stopped to the extent that this remains technically possible.

Where the payment amount has only been authorised and has not yet been finally captured at that time, the payment authorisation will be cancelled or released. In this case, no final charge will be made for the report.

Where, in exceptional circumstances, the payment has already been captured even though the service had not yet been fully performed when the withdrawal was received, the amount paid will be reimbursed in accordance with the applicable statutory provisions.

In this case, prokodo will not claim proportionate compensation for analysis services already performed before receipt of the withdrawal.

The personal report link will be sent to the email address provided by you when placing the order.
